What Does The Short Sale Accelerator Do?

How Does The Short Sale Accelerator Work?

How Is The Cloud On Title Removed?

• The cloud on title may be released by the parties by recording a release of contract in form suitable for recordation.

• Real estate agents use such a form when a contract is cancelled because a condition precedent cannot eb satisfied such a financing. Second, any person with an interest in the property can file suit to quiet title asking the court to cancel the contract. Finally, the foreclosure court, in theory, could issue an order removing the cloud on title but, because of the way foreclosures are being rushed to judgment, this is very unlikely to occur.

• The easiest, least expensive solution to removing the cloud on title is acceptance of the short sale.


If A Short Sale Contract Is Terminated, Can The Short Sale Accelerator Be Used For A Subsequent Contract?


• So long as a release is recorded for the terminated contract.

• A new Memorandum of Contract may be recorded for a subsequent short sale.

What Happens If A Short Sale Contract Is Canceled?


• If and when a contract is terminated, the parties should execute a release.

• Where a memorandum of contract has been recorded, the release should be acknowledged before a notary by buyer and seller. The original should be held by the seller.

• The release should only be recorded by the seller if a new short sale contract is executed. The seller may decide whether or not to provide to or withhold from the lender the notarized release.

• For example, the seller may be unable to find the notarized release when the creditor requests it. Under no circumstances should real estate agents retain an original copy of the notarized release or, absent a subpoena, provide a copy to the lender.
